Terms of Sale

1 How it works

1.1  Once you have ordered and paid for your goods in the web store, VM Education Pte Ltd will send you an e-mail confirming the receipt for your payment online, details of your order and details regarding delivery, providing that you submitted an accurate e-mail address when placing your order.

1.2  We cannot guarantee that all the ordered goods are available in our inventory at all times but we will ship these as soon as possible.

2 Order Details
2.1  We encourage you to print or save a copy of these Conditions, your payment information for paying online and shipping confirmation e-mail immediately upon receipt, in case you need to contact us with any questions about your order.

2.2  If you notice that any of the information emailed to you is incorrect please contact us immediately so we can correct it.

3. Products and Pricings
3.1  All prices stated are exclusive of Taxes. Taxes will be included only when checking out.

3.2  While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.

3.3  If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

3.4  Delivery costs are as stipulated in the Shipping and Handling section and will be added to all orders.

3.5  VM Education Pte Ltd reserves the right, at any time, to modify, suspend, or discontinue the sale of any Product or service with or without notice.

3.6  You agree that VM Education will not be liable to you or to any third party for any modification, suspension, or discontinuance of any Product or service.

4.  Portrayal of Product

4.1  While every effort has been made to portray items accurately, slight variations may occur.

4.2  All measurements quoted are approximate and the reproduction of colors is as accurate as photographic and publishing processes will allow.

4.3  Please note there may be variations in colors dependant on the calibration and settings of individual screens.

4.4  LEGO Education makes reservations for any typing errors which may occur on the website.

5.  Payment

5.1  For each Product or service you order on the Web store, you agree to pay the price applicable for the Product or service as of the time you submitted your order (“Product Price”), the delivery fees for the delivery service you select “Delivery Fees”), and relevant taxes.

5.2  VM Education Pte Ltd will automatically bill your credit card or PayPal account submitted as part of the order process for such amounts, and you hereby authorise us to do so.

​

5.3  All payments are non-refundable (With exception to Clause 3.3). We will only fulfil your order once we’ve received the full payment.

​

5.4  Successful completion of payment does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

6 Delivery

Delivery is only made to addresses in Singapore. All deliveries will be fulfilled by a 3rd party vendor. Delivery will usually take 3-5 days and are estimates. Duck Learning makes every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. Duck Learning reserves the right to make deliveries in installments. Duck Learning will send you an email when your order is shipped.

By completing your order on our webstore, you certify that you have verified your delivery address as being accurate and complete. You additionally confirm that an authorized person will be available at that address on the estimated delivery date.

Duck Learning shall not be liable for any damages or claims related to delayed shipments. If you must have a product by a certain date, we strongly encourage you to self-collect the order from our office.

2.7 Products Return Policy 

1. a) Damaged Products: If the Product arrives damaged (“Damaged Product”), Duck Learning will accept returns for a full refund only in accordance with the Return Procedures below. Provided that Duck Learning confirms that your Product was a Damaged Product and was returned in accordance with the Return Procedures below, your sole and exclusive remedy is that (a) we will issue a refund to your credit card or PayPal account in the amount charged for the Damaged Product (if your credit card has already been charged for the Product) or (b) we will not charge your credit card or PayPal account for the Damaged Product. The refunded amount will include the applicable Delivery Fee.

2. b) Return Procedures: All returns must be made within 14 days after the Product shipment date. All returned Products must be unused and returned in its original packaging. You are solely responsible for the cost of shipping the returned Product. All Products not returned in accordance with the Return Procedures shall be sent back to you, and no credit or refund will be issued. If returning items to us by post, you are strongly advised to obtain proof of posting. We cannot accept responsibility for parcels lost in transit.

3. Liability

Duck Learning assumes no liability other than what follows of statutory legislation. Duck Learning cannot in any event be held liable for any indirect or consequential losses, including but not limited to loss of or damage to data through use of any Duck Learning web site.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Duck Learning, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

1. Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
